Please read these Terms of Service ("Terms") carefully before using the PointMate mobile application (the "App") operated by PointMate Pty Ltd (ACN 697 700 860) ("we", "us", "our", or "PointMate"). By downloading, installing, or using the App, you agree to these Terms. These Terms are intended to be fair and reasonable for a free consumer app with an optional paid subscription. If you do not agree to these Terms, please do not use the App.

1. About the App

The App is a loyalty points conversion, comparison, and estimation tool designed for Australian consumers. It helps users estimate the value of loyalty points across various programs, compare credit card rewards, and make more informed decisions about how they earn and use their points. The App is operated by PointMate Pty Ltd.

2. Not Financial Advice

THE APP IS AN INDEPENDENT CALCULATOR AND COMPARISON TOOL FOR GENERAL INFORMATION ONLY. ALL OUTPUTS, INCLUDING VALUES, RANKINGS, COMPARISONS, AND ESTIMATES, ARE BASED ON YOUR SELECTED INPUTS AND THE APP'S CURRENT ASSUMPTIONS. NOTHING IN THE APP CONSTITUTES PERSONAL FINANCIAL ADVICE, CREDIT ADVICE, CREDIT ASSISTANCE, INVESTMENT ADVICE, TAX ADVICE, OR A RECOMMENDATION TO APPLY FOR, RETAIN, CANCEL, OR USE ANY FINANCIAL OR CREDIT PRODUCT.

PointMate Pty Ltd does not hold an Australian Financial Services Licence (AFSL) or an Australian Credit Licence (ACL) and is not authorised to provide personal financial advice or credit assistance.

The estimated values, comparisons, calculations, and rankings displayed in the App are based on publicly available information and general assumptions. They do not take into account your individual circumstances, spending patterns, tax situation, or financial objectives or needs. Output labels such as "Top-ranked" or "Highest estimated net benefit" reflect calculation results on your selected inputs, not a recommendation to take any particular action.

Before making any financial decision, including applying for a credit card or redeeming loyalty points, you should:

  • Consider your own financial situation and objectives;
  • Read the relevant Product Disclosure Statement (PDS), Target Market Determination (TMD), and terms and conditions from the product issuer;
  • Seek independent professional financial advice if appropriate. The App does not consider your objectives, financial situation, or needs.

3. No Affiliation with Card Issuers or Loyalty Programs

The App is an independent tool and is not affiliated with, endorsed by, or sponsored by any credit card issuer, bank, loyalty program, airline, or other financial institution mentioned in the App.

All product names, trademarks, logos, and brand names are the property of their respective owners and are used in the App for identification purposes only. Use of these names does not imply any endorsement or affiliation.

PointMate Pty Ltd does not receive commissions, referral fees, or other compensation from card issuers or loyalty programs for displaying their products in the App.

4. Accuracy of Information

While we endeavour to keep the information in the App accurate and up to date, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, or services contained in the App. This does not affect any non-excludable rights or remedies you may have under the Australian Consumer Law.

Card details, earn rates, annual fees, bonus point offers, perks, and loyalty program redemption rates change frequently. The App's data is updated periodically but may not reflect the most current information at all times. The date of the last data update is displayed within the App.

Some perk values displayed in the App (marked with "est.") are estimated based on comparable market rates and are not stated or guaranteed by the card issuer. Actual value depends on your personal usage.

You should always verify current details directly with the relevant card issuer or loyalty program before acting. Surcharge rates, merchant fees, and payment scheme rules may change.

5. Eligibility

To use the App, you must be:

  • At least 18 years of age (or the age of majority in your jurisdiction);
  • A resident of Australia or accessing the App from within Australia;
  • Capable of forming a legally binding agreement.

6. Subscriptions

6.1 Free Tier: The App offers a free tier with feature and capacity limits. Free-tier users may see non-personalised advertisements served by Google AdMob. Ads are not targeted based on your activity, interests, or identity. All data entered by free-tier users is stored locally on the device and persists between sessions, subject to the applicable capacity limits for each feature (for example, the number of cards in Pay or programs in Portfolio).

6.2 Premium Subscription: Premium features are available through a paid subscription at the prices displayed in the App. Subscriptions are billed through Apple App Store or Google Play Store, managed by RevenueCat, and are subject to the terms and conditions of the relevant app store.

6.3 Free Trial: New users may be offered a free trial of Premium features. At the end of the trial period, you will revert to the free tier unless you subscribe. Trial terms are displayed at the time the trial is offered. Data you enter during the trial will persist on your device after the trial ends, subject to the free-tier capacity limits.

6.4 Cancellation: You may cancel your Premium subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of your current billing period. Refunds for partial billing periods are handled by the relevant app store in accordance with its refund policy and applicable law, including the Australian Consumer Law.

6.5 Price Changes: We may change subscription prices from time to time. Any price change will take effect at the start of your next billing period after the change. We will provide reasonable notice of any price increase through the App or the relevant app store. You may cancel your subscription before the new price takes effect.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose;
  • Attempt to reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law;
  • Copy, modify, or distribute the App or any part of its content without our prior written consent;
  • Use automated tools to scrape, harvest, extract, or bulk-copy data from the App, whether for commercial or non-commercial purposes;
  • Transmit any viruses, malware, or other harmful code through the App;
  • Misrepresent your identity or impersonate any person or entity;
  • Interfere with or disrupt the App's functionality or servers;
  • Use the App's data, calculations, rankings, or content to build, train, or operate a competing product or service;
  • Reproduce, republish, or redistribute proprietary data from the App (including card data, redemption rates, benchmark ranges, and calculated values) without our prior written consent.

8. Intellectual Property

The App, including its design, code, content, data, graphics, logos, and user interface, is the intellectual property of PointMate Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.

The card database, redemption rate data, program information, and calculated values within the App are compiled and maintained by PointMate Pty Ltd and constitute our proprietary content.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User-Generated Content

Custom cards, wallet entries, and other data you enter into the App are your content. You retain ownership of this content. This data is stored locally on your device and is not accessed, collected, or shared by PointMate Pty Ltd.

10. Local Notifications

The App may request permission to schedule local on-device notifications, such as card cancel-by date reminders from PM Wallet. These notifications are generated and delivered entirely on your device. You can disable notifications at any time through your device settings.

We do not currently send remote or marketing push notifications. If this changes in the future, we will update these Terms and seek your consent where required.

11. Limitation of Liability

11.1 AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

11.2 EXCLUSION OF CERTAIN DAMAGES

Subject to Section 11.1, and to the maximum extent permitted by law, PointMate Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or in connection with your use of or inability to use the App, regardless of the cause of action.

11.3 LIABILITY CAP

Subject to Section 11.1, where PointMate Pty Ltd has liability that can lawfully be limited, our total aggregate liability to you for all claims arising from or in connection with the App is limited, at our election, to: (a) resupplying the relevant services; (b) paying the cost of having the relevant services resupplied; or (c) the total amount of fees you have paid for the App during the 12 months immediately preceding the event giving rise to the claim. For free-tier users who have not paid any fees, our liability is limited to resupplying the services.

11.4 NATURE OF THE APP

You acknowledge that the App is a calculator and comparison tool that provides estimates based on publicly available information and assumptions. Outputs may contain errors, inaccuracies, or omissions. The App is not a substitute for independent professional advice. You are responsible for verifying information and for any decisions you make based on the App's outputs.

12. Disclaimer of Warranties

Nothing in this section excludes, restricts, or modifies any statutory consumer guarantee under the Australian Consumer Law or any other non-excludable right or remedy.

Subject to the above, the App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the App.

13. Indemnification

You agree to indemnify and hold harmless PointMate Pty Ltd from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your unlawful conduct in connection with the App;
  • Your deliberate misuse of the App or its content;
  • Your infringement of PointMate Pty Ltd's intellectual property rights; or
  • Your breach of these Terms.

This indemnity does not extend to any loss or damage caused by PointMate Pty Ltd's own acts, omissions, negligence, or breach of these Terms.

14. Third-Party Links and Services

The App may contain links to third-party websites (such as loyalty program provider websites). These links are provided for your convenience only. We do not control and are not responsible for the content, privacy policies, or practices of any third-party website.

Your interactions with third-party services, including app store providers (Apple, Google), subscription management (RevenueCat), non-personalised advertising (Google AdMob), and analytics providers (Firebase Analytics, Firebase Crashlytics), are governed by the respective third party's terms and conditions and privacy policies.

15. Modifications to the App and Terms

15.1 App Changes: We may modify, update, suspend, or discontinue the App (or any part of it) from time to time. Where practicable, we will provide reasonable notice of significant changes through the App. We may take immediate action without notice where necessary for legal compliance, security, or to address misuse. If the App is discontinued, active Premium subscribers may cancel their subscription through their app store account.

15.2 Terms Changes: We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App and updating the "Last updated" date. We will provide reasonable notice of changes that materially affect your rights. You may stop using the App if you do not agree to updated Terms, and active Premium subscribers may cancel their subscription through their app store account.

16. Termination

We may terminate or suspend your access to the App if you materially breach these Terms, engage in unlawful conduct, or misuse the App. Where practicable, we will provide notice and an opportunity to remedy the breach before termination, except where immediate action is necessary for legal compliance, security, or to protect other users.

You may stop using the App at any time by uninstalling it from your device. If you have a Premium subscription, you must cancel it separately through your app store account settings to avoid continued billing.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.

Before commencing any legal proceedings, you agree to first attempt to resolve any dispute by contacting us at support@pointmate.au and engaging in good-faith negotiations for a minimum period of 30 days.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PointMate Pty Ltd regarding your use of the App and supersede any prior agreements, communications, or understandings.
